GC Principles

1

We focus our reporting on the workforce by employment type on employees and apprentices. Besides, we publish the percentage of employees working part-time for BASF SE.

2

Due to different cultures and labor market conditions there are differences in employee turnover rates across regions. We do not tolerate discrimination based on nationality, gender, religion or any other personal characteristics within the BASF Group.

3

We do not tolerate discrimination based on nationality, gender, religion or any other personal characteristics within the BASF Group . Part-time employees are provided with the same benefits as fullt-time employees.

4

BASF complies with the laws and respects the customary practices of the countries in which we operate. We ensure a constructive cooperation with employee representatives. We inform employee representatives in sufficient time in the forefront on significant operational changes. The point of time is selected as to provide the employee representatives with enough time to understand, evaluate and consult, as well as to hear or to discuss with the company representatives. We involve our employees in work and decision processes in a timely manner through open communication and information sharing not hindered by hierarchical and organizational boundaries.

5

All employees of BASF in Germany are represented in formal joint management-worker health and safety committees which meet at least once per quarter in order to discuss important aspects of occupational safety. Key topics are in-depth and systematic risk assessments, ensuring that our managers lead the way by acting as role models and the active committment of employees. With our new global safety initiative, we go beyond traditional methods. We aim to positively influence the attitude of every single employee when it comes to safety with the four elements of “Safety Champions”: function of managers as role models, personal responsibility, open dialog, and employee involvement. On a global basis, we employ local programs and measures developed and implemented according to the specific needs of individual sites.

6

We defined occupational accidents and lost days, potential occupational diseases, the complience to our guidelines for protective medical emergency planning, the training of first aid responders as well as occupational health suveillance examinations and health promotion activities as our core indicatores for occupational health and safety. The executive team is recruited, selected, developed and positioned systematically based on the following four criteria: Knowledge, skills, leadership competencies and conduct in accordance with our Values and Principles.

7

We align our training and education activities according to the needs of each employee. We do not tolarate any discrimination due to nationality, gender, religion or any other personal characteristics.

8

We seek employees of all cultures and nationalities who, with their interpersonal and professional competencies, are willing to devote their talents and skills to meet our objectives and to support our Values. The executive team is recruited, selected, developed and positioned systematically based on the following four criteria: Knowledge, skills, leadership competencies and conduct in accordance with our Values and Principles.

9

BASF is committed to company wide standardized compensations systems that are based on market, function and performance. Internal analyses showed that there are no discriminatory regulations within BASF regarding the payment. There are no differences in compensation of women and men. BASF is committed to performance-related compensation based on global principles and in line with the market; remuneration that, at the very least, meets the legal minimum wage and employee participation in the company’s success. Valid minimum wage (defined by law, collective contracts or operational) is defined for 98% of our employees. Minimum wage is set by collective contracts for 56% of our employees. 93% of group companies offer annual bonuses for their employees, these companies employ 98% of our employees.

10

The effects of our foreign direct investment on sustainable development were for example analyzed in a study by the German Society for International Cooperation (GIZ) in Nanjing, China and are publicly available. As founding member of the Global Compact, we strive to contribute to the protection and awareness of human rights within our spheres of influence. Human rights aspects are part of our risk management system for investment planning. The exact numer of BASF investment agreements are confidential business relevant information, that are therefore not reported. We have expert teams who act as advisers on sustainability during the integration of acquired companies.

11

Labor and social standards are part of the BASF Compliance Training. Therefore we report the number of participants instead of the ours of trainig

12

We assess the impacts of our business on the einvironment. For example we commissioned the Gesellschaft für Technische Zusammenarbeit to provide a study about the impacts of our foreign direct investment in Nanjing, China. The results can be found on our website. The study "BASF investments at the Guaratinguetá site - Analysis of socio-economical and ecological impacts on the environment" - was conducted to the 50th anniversary of the brazilian site.

21

Due to different cultures and labor market conditions there are differences in employee turnover rates across regions. Additionally there are legally different determining factors of parental leave. We provide our employees numerous return options, e.g. part-time work. Within the BASF Group we do not tolerate discrimination based on nationality, gender, religion or any other personal characteristics. Worldwide our fluctuation rates are in the lower single-digit area. This also reflects our good positioning in the competitive environment for the best specialists and executive staff.
