Fulfilment & Comment

GC Principles

1

Due to different cultures and labor market conditions there are differences in employee turnover rates across regions. We do not tolerate discrimination in the workplace and measure our employees’ satisfaction with the help of our Global Employee Survey.

2

We do not tolerate discrimination based on nationality, gender, religion or any other personal characteristics within the BASF Group. Part-time employees are provided with the same benefits as fullt-time employees.

3

BASF complies with the laws and respects the customary practices of the countries in which we operate. We ensure a constructive cooperation with employee representatives. We inform employee representatives in sufficient time in the forefront on significant operational changes. The point of time is selected as to provide the employee representatives with enough time to understand, evaluate and consult, as well as to hear or to discuss with the company representatives. We involve our employees in work and decision processes in a timely manner through open communication and information sharing not hindered by hierarchical and organizational boundaries.

4

All employees of BASF in Germany are represented in formal joint management-worker health and safety committees which meet at least once per quarter in order to discuss important aspects of occupational safety. Key topics are in-depth and systematic risk assessments, ensuring that our managers lead the way by acting as role models and the active committment of employees. With our new global safety initiative, we go beyond traditional methods. We aim to positively influence the attitude of every single employee when it comes to safety with the four elements of “Safety Champions”: function of managers as role models, personal responsibility, open dialog, and employee involvement. On a global basis, we employ local programs and measures developed and implemented according to the specific needs of individual sites.

5

We have defined the following as relevant indicators for successful work in the area of occupational safety: lost-time injury rate, confirmed occupational diseases, the fulfillment of our requirements for medical emergency planning, first-aid training and preventive medicine and health promotion.

6

All employees of BASF in Germany are represented in formal joint management-worker health and safety committees which meet at least once per quarter in order to discuss important aspects of occupational safety. Key topics are in-depth and systematic risk assessments, ensuring that our managers lead the way by acting as role models and the active committment of employees. On a global basis, we employ local programs and measures developed and implemented according to the specific needs of individual sites.

7

We align our training and education activities according to the needs of each employee. We do not tolerate any discrimination due to nationality, gender, religion or any other personal characteristics.

8

We want to attract employees from all cultures and nationalities who are willing to commit their social, intercultural and technical expertise to the strategic goals and values of our company. The management team is recruited, selected, developed and positioned according to the following four criteria: knowledge, skills, personal competencies, leadership ability and acting in line with our strategic principles and values. All employees and managers act in accordance with our four values: Creative, Open, Responsible and Entrepreneurial.

9

BASF is committed to uniform, Group-wide remuneration principles in line with the market and which reflect responsibility and performance (performance and market-related compensation systems based on global principles). Internal analysis has shown that there are no discriminatory provisions in BASF’s compensation. There is no difference in pay between men and women with comparable jobs and qualifications. BASF is committed to remuneration that, at the very least, meets the legal minimum wage, and to employee participation in the company’s success. Not all countries have adopted a minimum wage, however. A minimum wage exists for 96% of our employees (whether by law, by collective bargaining agreement or through the company). For 64% of our employees, a minimum wage is stipulated by collective bargaining agreements. 97.5% of our Group companies pay an annual bonus based on the company’s success; these Group companies account for 99.5% of our employees. For companies in which collective bargaining agreements do not stipulate a minimum wage, remuneration is significantly above the legal minimum wage in most cases.

10

Due to different cultures and labor market conditions there are differences in employee turnover rates across regions. Additionally there are legally different determining factors of parental leave. We provide our employees numerous return options, e.g. part-time work. Within the BASF Group we do not tolerate discrimination based on nationality, gender, religion or any other personal characteristics. Worldwide our fluctuation rates are in the lower single-digit area. This also reflects our good positioning in the competitive environment for the best specialists and executive staff.

11

The effects of our foreign direct investment on sustainable development were for example analyzed in a study by the German Society for International Cooperation (GIZ) in Nanjing, China and are publicly available. As founding member of the Global Compact, we strive to contribute to the protection and awareness of human rights within our spheres of influence. Human rights aspects are part of our risk management system for investment planning. The exact numer of BASF investment agreements are confidential business relevant information, that are therefore not reported. We have expert teams who act as advisers on sustainability during the integration of acquired companies.

12

Our Supplier Code of Conduct includes human rights-related standards, e. g. social and labor as well as occupational safety standards. In 2012, we sourced raw materials from more than 6,000 suppliers. Based on risk matrices, we audited 210 suppliers also with regards to occupational safety standards. We terminated the relationship with 6 suppliers due to a lack of improvement. Also based on risk matrices, 750 raw material suppliers received self-assessment questionnaires on social and labor standards.

13

There have been no incidents of violations involving rights of indigenous people during the reporting period.

14

We report both the total number of grievances related to human rights (i.e. social & labour standards, occuptional health & safety, etc.) filed & addressed, as well as the total number of grievances verified and resolved through counter-measures. Our external Compliance Hotlines serve as our formal grievance mechanism. They are effectively used by our own as well as contracted employees (i.e. internal stakeholders). We therefore do not break down the number by internal and external stakeholders. Furthermore, our Compliance Hotlines grant anonymity to the callers. Regarding external employees: Our Community Advisory Panels serve as the platform to address concerns by the communities around our sites. Our supply chain management addresses human rights-related performance by our suppliers.

15

We assess the impacts of our business on the environment. For example we commissioned the Gesellschaft für Technische Zusammenarbeit to provide a study about the impacts of our foreign direct investment in Nanjing, China. The results can be found on our website. The study "BASF investments at the Guaratinguetá site - Analysis of socio-economical and ecological impacts on the environment" - was conducted to the 50th anniversary of the brazilian site.

16

Percentage of business units not applicable as we report on a production site basis and therefore report the number of audits.

17

We do not report the number of incidents or disciplinary punished legal cases. Reason for that are internal corporate decision processes which are based on the basic idea that such compliance cases implicate confidential and proprietary information and are therefore not accessible to the public at large.
